Terms and Conditions

The purchase of products presented on the website Solaris-sunglasses.com implies that the customer assents to these general conditions of sale and accepts all the provisions without any reservations. These conditions exclusively concern non trading individual persons. Thus, it is expressly prohibited to buy one or several items on the website Solaris-sunglass.com with the purpose of reselling them.

1. PURPOSE

These terms and conditions define the modalities for placing the orders, sale, delivery and after sales between Solaris SAS  and the customer.

2. THE ORDER

Any order implies acceptance of the price and the description of the products available for sale provided on the website Solaris-sunglass.com.

In order to ensure the customer's will, Solaris SAS undertakes to confirm all orders by e-mail before delivery.
This confirmation shall include the note on the ordered product, its price, the terms of payment and its terms of delivery.
Only those orders for delivery in Metropolitan France, Corsica, Monaco and towards to Overseas French Departments and Territories will be taken into account by Solaris On the net.

The company Solaris SAS keeps the right to cancel or refuse any order from a customer with whom there exists a litigation relating to the payment of an earlier order.  

3. AVAILABILITY

The offers of products and prices are valid as long as they are announced on the website Solaris-sunglass.com, within the limits of stocks available.

In this regard, the indications on the availability of the products are provided to the customer at the time of placing the order. As this information comes directly from the suppliers, there may be errors or modifications exceptionally. Should a product not be available after the order is placed, the customer shall be informed thereof immediately by mail as soon as the suppliers receive the information. The customer's order will be automatically cancelled and he will be immediately reimbursed if his bank account has been debited.

4. THE TERMS OF PAYMENT

The customer must pay for his online purchase while placing the order by one of the following means of payment:
- French credit cards (Carte Bleue, Visa, Mastercard, American Express card)
- Solaris Gift Vouchers

The products will be shipped only after receipt of payment by Solaris-sunglass.com. 

MEASURES TO COMBAT PAYMENT FRAUD
To step up the security for the means of payment used by its customers, SOLARIS SAS, in partnership with SECUVAD SAS, may need to request proof of identity and/or place of residence and/or means of payment used. 
Failure to transmit the documentary proof requested may result in the order concerned being refused by SOLARIS. 
The dispatch or delivery of the products ordered may be delayed according to the time taken to forward the requested documentary proof. 
Information relating to your order is forwarded to SECUVAD SAS for automated processing of the data which will come under the responsibility of SECUVAD SAS. The purpose of this automated processing is solely to protect the use of your means of payment and guard against fraudulent use of means of payment on our site. 
SECUVAD SAS is the only recipient of any documentary proof that may be requested once the order has been placed. 
Pursuant to the amended French Data Privacy Act dated 6 January 1978, you are entitled to access, rectify and make formal objection at any time to any of your personal data by addressing a letter by post, with proof of identity, to SECUVAD SAS, Legal Department, 107 Avenue Georges Clemenceau, 92000 – NANTERRE.
FAILURE TO PAY 
Should a single amount not be paid on the agreed date, all other outstanding sums will become due with resulting application of the penal clause.
RESOLUTORY CLAUSE
In the event of failure to pay on due date, the sale will be cancelled ipso jure 48 hours after receipt of official notification by registered letter with recorded delivery. The sale will be cancelled ipso jure without the need for further formalities in the event of legal administration or bankruptcy. The penal clause will be applied in the event of implementation of the resolutory clause. 
PENAL CLAUSE
In the event of failure to pay on due date, the purchaser will, with respect of the penal clause, be obliged to pay a fixed sum of €150.00 in addition to the selling price.  SOLARIS SAS will permanently have the benefit of this penal clause without having to provide justification of any prejudice whatsoever. The penal clause will be automatically applied in the event of implementation of the resolutory clause.
 
5. RATES

These prices are applicable in the framework of e-commerce. In any case, they cannot be applied in Solaris boutiques in France or abroad (and vice versa).

The prices are indicated in Euros inclusive of all taxes. They take into account the VAT applicable on the date of order. These prices exclude post and package costs.
Any change in the rate of applicable VAT can be reflected on the price of the products.

Solaris SAS keeps the right to modify its prices at any time but the products will be invoiced on the basis of the rate in force at the time of registering the orders.
In any case, the products remain the property of Solaris On the Net till full payment of the purchase price.
 
6. GUARANTEES

1. Withdrawal

Under Article L 121-20 of the French Consumer Code, the customer has a seven day withdrawal period from the date of delivery of the ordered product, during which he may return the purchased product to Solaris SAS.

However, in order to provide the best service to its customer Solaris SAS has extended this possibility of withdrawal to 15 days from the date of delivery of the ordered products.
If the customer exercises this right of withdrawal, the products must be returned in their original packing (or in its absence, protected by a foam in a RIGID carton), in a perfect state, along with all the accessories and notices, if any, and the return form duly filled.

Incomplete, damaged, used or spoilt items cannot be taken back.

The costs for returning are borne by Solaris SAS for a first return from Metropolitan France (one return per year and per customer, same name, same address) and by the customer for following returns. For the taking in charge of the first return, all the customer has to do is to contact the Customer Relations department by mail through a form or by telephone. Solaris On the Net shall send to the customer by post a Colissimo transport label which must be stuck on the parcel for shipment in the nearest post office.

Solaris SAS is liable for reimbursement of the sums paid by the customer for the returned goods, except for participation in the costs for sending, if any. The reimbursement is owed by Solaris On the Net within thirty days maximum from the date of receipt of the returned product.

The reimbursement can be made by crediting the bank account of the card used for the payment, by letter cheque or by bank cheque drawn in the order of the customer.

In order to return a product, the customer will have to contact the Customer Relations department beforehand who will indicate the steps to be taken:
- either by e-mail by filling an appropriate form [a reason for the return cannot be asked],
- or by telephone.

The Customer Relations department will send a confirmation by e-mail that the customer must print and attach to his parcel. On receipt of the parcel by our services and after control, an e-mail of acceptance of your return will be sent to you.

2. Damage during transport

In case of damage during transport, the customer must refuse the damaged product and mention "Refusal for damage" on the signature sheet.
By signature of the receipt of delivery without specific reservations, and acceptance of the products, the customer acknowledges having received the goods in a satisfactory state.
From that point on, any claim relating to the state of the delivered products cannot be accepted.

3. Guarantee against manufacturing defects

The products sold on the website Solaris-sunglass.com are guaranteed against any manufacturing defects during a period of 2 years from the discovery of the defect.
 
7. SIGNATURE AND EVIDENCE 

Any user of the site who does not have a customer number must follow the registration procedure allowing him to obtain his customer number.
This number is personal.

In any case, the providing of the credit card number and final validation of the order on line will imply evidence of the entire order and will imply payability of the sums engaged by including the items appearing on the order form.

8. LIABILITY 

The liability of Solaris SAS cannot be engaged in the case where the non performance of its obligations is attributable either to an unpredictable and insurmountable act by a third party to the contract or in case of a force majeure event as defined by French case law.

Similarly, the liability of Solaris SAS cannot be engaged for any inconvenience or damage inherent to the use of the Internet network, notably interruption in the service, an external intrusion or the presence of computer virus.
 
9. NOMINATIVE INFORMATION

Solaris SAS keeps the right to collect the information on the customer.

The customer is informed that the automatic treatment of information, notably the management of e-mail addresses of the users has been subject matter of a declaration with the National Commission for Data Protection and Liberties (CNIL) (declaration number 1206627).
The information collected through the website Solaris-sunglass.com can be transmitted to partner companies in order to get the customer benefit from appropriate commercial orders.

As per the law of 6 January 1978, the customer has a right of access and rectification for any information concerning him either directly on the Internet or by letter to Solaris On the Net – Customer Relations Department - 18 Parc Ariane 3, 5 rue Alfred Kastler - 78284 Guyancourt cedex.
Solaris On the net implements all the means for ensuring the confidentiality and security of the information transmitted on the net. In this regard, the internet site uses a secured module of payment, hosted by its partner bank Crédit Mutuel, via the service CyberMut. 

10. INTELLECTUAL PROPERTY

All the information of Solaris-Sunglass.com is protected by an intellectual property right.

They are the exclusive property of the company Solaris SAS. Any legal or physical person who wishes to put a link on his website directing directly to a page of Solaris-Sunglass.com website, must compulsorily ask for authorisation to the company Solaris On the Net.

In any case, any link, even if tacitly authorised must be removed on a simple request by Solaris On the Net.   

11. FULL DOCUMENT

In the event where one of the clauses of these general terms and conditions of sale is null and void due to a change in the law, regulation or a court's decision, it shall not have any consequence on the validity and compliance of these general terms and conditions of sale.

12. DURATION

These conditions apply during the entire period when the services offered by Solaris SAS are online.

13. EVIDENCE

The computerised registers conserved in the computer systems of the company Solaris SAS and its partners under reasonable conditions of security will be considered as evidence of communication, orders and payments that took place between the parties.

14. CONSERVATION AND ARCHIVING OF THE TRANSACTIONS

The archiving of the order forms and invoices is done on a reliable and durable support in such manner as to provide a loyal and durable copy.

15. APPLICABLE LAW

These terms and conditions are subject to the French law.

16. CONDITIONS OF DELIVERY

1. Period

Any purchase made on the website Solaris-Sunglass.com before 11 a.m. will be dealt with the same day. The shipping periods are as follows:

For any order placed after 11 a.m. the period will be counted from the next day. For any order placed during a week end or on public holidays, the period will be counted from the next working day.
These periods are for information depending only on the transporter and cannot, in any case, engage the liability of Solaris SAS.

2. Costs

For any item purchased on the website,
Delivery by COLISSIMO within Metropolitan France will be invoiced 6€ by Solaris On the Net;
Delivery by Chronopost will be invoiced 15 € per item delivered towards Metropolitan France;
Delivery by COLISSIMO towards the French Overseas Departments will be invoiced 12 €;
The delivery by Chronopost will be invoiced 30 € per item delivered towards the French Overseas Territories.
Delivery by GLS towards the UK, Spain, Portugal and Spain will be invoiced 15 €. 

The customer has the choice of getting himself delivered:
- either at the address of invoicing,
- or any other particular address than that of invoicing.
